Terms and Conditions
Smart Website Starter Plan
These Terms & Conditions (“Agreement”) govern the Smart Website Starter Plan and related services provided by Smart Website by Jun Pasion (“Provider,” “we,” or “us”) to the client (“Client,” “you”). By purchasing or using our services, you agree to be bound by the terms below.
1. Service Overview
The Smart Website Starter Plan includes the setup and customization of a website of up to five (5) pages using one of our available templates, hosting, SSL security, and one (1) monthly content update.
No custom coding, custom design from scratch, or bespoke development is included unless purchased separately.
2. Pricing and Payment Terms
2.1 First-Year Fee
The cost for the first year of service is $47 USD. This includes:
- Up to 5-page website setup based on a selected template
- Basic branding and content integration
- Hosting and SSL security
- Five (5) website update per month
Payment is due in full before any work begins.
2.2 Renewal Fee
Beginning in Year 2, the service renews at $97 USD per year. Renewal maintains:
- Hosting and SSL
- Website accessibility and functionality
- One (1) monthly update
Non-payment of renewal may result in suspension or deletion of the website after 30 days.
3. Monthly Update Policy
The Smart Website Starter Plan includes five (5) update per calendar month. Updates must be content-based, such as:
- Replacing text
- Adding or replacing an image
- Updating business hours, contact info, or pricing
Updates do not include:
- New pages
- Custom graphics or branding
- Structural redesigns
- Complex development requests
Unused monthly updates do not roll over.
4. Additional Services (À La Carte)
Clients may purchase optional services:
- Booking Page + Automation — $27/mo
- Contact Form + Chat Widget + Email Automation — $27/mo
- CRM Access (GoHighLevel) — $97/mo
- Unlimited Monthly Website Updates — $27/mo
- Additional Website Page — $47/page
Bundle pricing (all options): Smart Business Growth Package — $97/mo
All add-ons are billed in advance and renew monthly unless canceled.
5. Domain Names
You may use your existing domain or request assistance to purchase one. Domain fees are not included in the Smart Website Starter Plan.
If you request domain setup, we register/manage it on your behalf unless otherwise agreed. Domains remain the property of the registrant indicated at purchase.
6. Ownership and Access
- Your content (text, images, brand assets) remains your property.
- The website files and hosting infrastructure remain the property of Smart Website Designer.
- If you terminate the service, you may request a static export of text and image content for safekeeping.
- Website templates, layouts, workflow automations, and proprietary systems are not transferable.
7. Term, Renewal & Cancellation
- The initial term begins upon payment and continues for 12 months.
- Services renew automatically at the yearly renewal rate unless canceled before the renewal date.
- Add-ons may be canceled at any time with at least 5 business days’ notice before the next billing cycle.
- No refunds are issued for partial periods or unused services.
8. Client Responsibilities
You agree to provide:
- Business details, branding assets, and page content in a timely manner
- Access credentials if integration with third-party systems is required
- Accurate and lawful content
We are not responsible for delays caused by missing information.
9. Content and Legal Compliance
Client is solely responsible for:
- Accuracy of business information and claims
- Obtaining permissions for all images, logos, or content provided
- Compliance with applicable laws, including privacy, data protection, and industry regulations
We reserve the right to refuse content that is illegal, discriminatory, harmful, or inappropriate.
10. Service Modifications
We may update features, pricing, or policies at any time. Existing clients will be notified before changes take effect. Continued use of the service constitutes acceptance.
11. Limitation of Liability
We provide the website and related services on an “as-is” basis. To the fullest extent permitted by law:
- We are not liable for indirect, incidental, or consequential damages
- Our total liability shall not exceed the fees you paid for the service in the preceding 12 months
12. Governing Law
This Agreement is governed by the laws of the jurisdiction in which the Provider is registered. Any disputes will be resolved under that jurisdiction.
13. Acceptance of Terms
By ordering, using, or continuing the service, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
